摘要：
本文研究議題為著作權法制面對Web 2.0環境之制度調整思考。本文首先說明Web 2.0環境下著作創作與利用的特性，並藉由「業餘創作者大幅增加」與「大量、多樣、小額」此二特性，闡述著作權制度面臨之重要議題，包括：作者在著作權保護方面的多元需求、現有授權機制無法提供適當授權方案、合理使用制度無法有效保護創作者。最後則透過著作權法制核心概念係「促進著作流通利用」的觀點，對於現行著作權制度進行檢視並提出建議。

 

Abstract:
At first, this paper raises the question on the impacts of Copyright System in Web 2.0 environment.  This paper describes characteristics of work creation and use in Web 2.0 environment, such as "the huge number of amateur" and "great quantity, multiform and micro use" and bases on the two characteristics to discuss the difficulties of copyright law system when facing Web 2.0 environment, including the multiple demands of author for protecting the copyright, the current license system may not providing appropriate license solution for users and the current fair use clauses may not be enough to protect the author for using other's work.  Finally, from the point of view that the core concept of Copyright System is encouraging circulation and use of copyrighted work, this paper examines several issues of Copyright System and gives some suggestions to the copyright authority.
