數位匯流下著作權制度之檢討

期末報告書摘要

隨著數位科技及寬頻網路的發展，電信、廣電、網路逐步整合所形成之數位匯流趨勢，乃是各國在進行有關電信、廣播、電視等公共資源的管制上極為重視的議題。就著作權法制而言，數位匯流乃是重要的著作利用科技及環境的改變，對於社會著作利用顯有相當程度的影響，著作權法作為規範社會著作利用的基本法制，應如何因應此種科技及產業整合的變化，配合社會著作利用與產業發展之現況進行調整，以確保著作權法促進國家文化發展之立法意旨，確有必要予以重新檢討。

首先，本研究針對數位匯流環境之著作利用加以觀察，其次，對於著作種類、著作財產權、著作財產權限制（合理使用）、著作授權利用等方面，分析著作權法在數位匯流環境所面臨之問題，並進一步針對與數位匯流有關之必載頻道、P2P軟體濫用、經鎖碼載有節目訊號之保護三項議題加以討論，本研究認為數位匯流確實突顯著作權法制彈性不足，未來應朝使用者友善之方向發展，並就著作權議題加強與通訊傳播管制法規之整合。

Abstract

Accompaning with the development of digital technologyand broadband network, the integration of telecommunications, broadcasting,networks -- so called "Digital Convergence" has been an importantissue of the related public resources regulation for each governemnt. From thepoint of view of Copyright System, Digital Convergence is a very importantchange of the technology for using the Work and the Work using enviroment inour society. Copyright Act is the basic legal system of the Work using of wholesociety, how to modify the system to fit the change of the Work using and thedevelopment of our industry to insure the purpose of copyright system is a keyissue for our Copyright Act.

First, this study observes the use of work in DigitalConvergence environment; second, analyzes several copyright issues in DigitalConvergence environment, such as the work category, economic rights of work, limitationsof copyrights (fair use), license of copyright, and etc.; third, this studyalso discusses the must-carry channel, the abuse of P2P software and theprotection of encrypted program-carrying signals which related to DigitalConvergence. Finally, this study finds that the copyright system needs to bemore flexible in Digital Convergence environment, should be more user-friendlyand should be intergrated with the communication regulations.
